There are a number of funding options available in clinical negligence claims and we shall advise you upon the best method of funding available to you, which include
- Free Initial Advice - We offer a free initial appointment to discuss your claim with you and advise you whether or not we consider that your claim has sufficient merit to commence investigations. We shall then explain all funding options to you to enable you to decide if you would like to instruct us to represent you.
- Legal Aid – This is available for some clinical negligence claims. Your eligibility for Legal Aid depends upon your level of income, savings and the potential value of your claim. Keeble Hawson LLP is one of the few firms in South Yorkshire who are able to offer Legal Aid. We will consider your eligibility for Legal Aid at the outset of your claim.
- Legal Expenses Insurance – Clients often have Legal Expenses Insurance included within their existing insurance policies, such as home insurance, which shall cover all expenses relating to your claim. If you had a policy of Legal Expenses Insurance in force at the time of the negligence, we shall write to your insurers on your behalf to request that they fund your claim for clinical negligence and act for you in accordance with their terms and conditions.
- “No Win - No Fee” – If you are not eligible for Legal Aid and do not have an existing policy of Legal Expenses Insurance, we shall, wherever possible, act for you on the “no win, no fee” basis, under a Conditional Fee Agreement. If your claim is successful, having received your compensation, we shall then recover your legal fees separately from the Defendant. If your claim is not successful, we do not get paid.
- After the Event Insurance - The Conditional Fee Agreement covers our fees, but does not cover the cost of expenses such as the cost of obtaining your medical records and obtaining expert evidence. Keeble Hawson LLP is one of the few firms who are able to obtain a policy of After the Event Insurance on your behalf, which will fund all such expenses from the outset of your claim. This provides you with reassurance that you will have nothing to pay during the course of your claim, even if your claim is unsuccessful.
