Pre-nuptial agreements

At a time when the judiciary is being increasingly influenced by European and American legal thinking, we find that more clients are considering the case for pre-nuptial agreements.

Although such agreements cannot limit or exclude the authority of the court, emerging case law suggests that a properly drafted agreement, setting out the basis on which assets and income are to be distributed following the breakdown of a marriage or civil partnership, is likely to influence how the court will exercise that authority.

This influence is increased in cases where there are no children, the relationship has been relatively short, independent legal advice had been received by both parties prior to the signing of the agreement and where the terms of the agreement appear to be fair.
