Early warning of employment tribunal claims.
Since 6 May 2014, it has no longer been possible for workers to submit Employment Tribunal claims unless they have previously attempted "early conciliation" via ACAS and obtained a certificate to that effect.
This gives employers advance warning of impending claims for unfair dismissal, discrimination (and so on) and an opportunity to decide whether to resolve potential claims before they become embroiled in proceedings.
It may be possible through ACAS to persuade employees not to pursue claims at all, particularly bearing in mind the impact of fees that are now payable for employment tribunal applications.
