Empty Property Rate Relief For Newly Built Commercial Property

From the 1 October 2013 Local Authorities will have the discretion to award an empty property rate relief for newly built Properties. 

hlw Keeble Hawson logoThe relief is only temporary and applies to new properties completed after 1 October 2013 and before 30 September 2016 and which are unoccupied for the first 18 months following completion of the construction.

The basic position is that non-domestic empty properties are entitled to a three month or six month rate free period. Under the new relief a qualifying property may benefit from an additional 15 months or 12 months of rate relief.

Local Authorities have been issued guidance to assist them in determining if a property meets the qualifying criteria. The criterion provides that a property must:

  1. Be an unoccupied non-domestic Property comprised wholly or mainly of qualifying new structures; and
  2. Have been completed after 1 October 2013 and before the 30 September 2016, and less than 18 months before the date the relief is granted.

The relief will run with the Property. Therefore if the Property is sold on, the new owner will also benefit from the relief.
